These Terms of Service govern the use of Kindfollow, published by Amine Boutahar, sole proprietor (entrepreneur individuel), SIRET 934 629 726 00019, 30 rue Demarest, 95170 Deuil-la-Barre, France, hello@kindfollow.com (the "Publisher"). By creating an account you accept them in full.
1. The service
Kindfollow is an online tool that drafts replies to customer reviews for restaurants and similar venues. You paste a review, choose a tone, and Kindfollow proposes three replies written in your venue's voice and in the reviewer's language. You copy the one you prefer and publish it yourself on the review platform. Kindfollow does not publish anything on your behalf.
2. Account
The service is reserved for professionals acting on behalf of a venue they own or manage. You sign in with your email address (one-time link) or a Google account. You undertake to provide accurate information about yourself and your venue, to keep your email address current, and not to share your access. You are responsible for any use made of your account.
3. Your replies, your responsibility
The replies are suggestions produced by a language model from the review and the profile you entered. You remain the author and the sole person responsible for each reply you publish. You undertake to read every reply before publishing it, to correct anything inaccurate, and to comply with the rules of the platform where you publish it. Kindfollow does not guarantee the accuracy of a reply, the result it will produce, or its effect on a rating, a ranking or your reputation.
4. Plans and prices
- Free: ten free replies, without a card, to try the service.
- Google only: 12 US dollars per month.
- All platforms: 19 US dollars per month.
Prices are stated in US dollars, excluding taxes; applicable taxes depend on your country and are shown before payment. Paid plans are subject to fair-use caps of 300 generations per month for Google only and 1,000 per month for All platforms. A generation produces three replies. When the cap is reached, generation resumes on the first day of the following month.
5. Payment, renewal, cancellation
Subscriptions are paid monthly in advance by card through Stripe, our payment provider, and renew automatically each month. You can change plan, update your card or cancel at any time from the Account screen (Stripe customer portal). When you cancel, your plan stays active until the end of the period already paid, then your account returns to the free plan; no partial refund is made for the remaining days, except where the law requires it. If a payment fails, Stripe retries; if it still fails, the subscription is cancelled and the account returns to the free plan.
6. Right of withdrawal
If you are a consumer residing in the European Union, you have a right of withdrawal of 14 days from the subscription. However, the service is a digital content provided immediately: at the time of ordering you expressly request that the service begins right away and you acknowledge that you lose your right of withdrawal as soon as the first paid generation is performed. The box to tick before payment records this consent. Professionals do not benefit from a right of withdrawal.
7. Prohibited uses
- Writing or publishing fake reviews, or replies intended to deceive customers or platforms.
- Generating unlawful, defamatory, discriminatory, threatening or hateful content, or content that violates third-party rights.
- Circumventing the fair-use caps, sharing an account, or automating the service beyond normal use.
- Reselling, sublicensing or offering the service to third parties, or using it to build a competing service.
- Attempting to access another user's data or to compromise the security of the service.
8. Availability and liability
We do our best to keep the service available and to correct incidents quickly, but we do not guarantee uninterrupted or error-free operation, nor the availability of the third-party services we rely on (hosting, language model, payment). The service is provided "as is". To the extent permitted by law, the Publisher's liability for any damage related to the use of the service is limited to the amounts you paid during the twelve months preceding the event. Indirect damage, loss of revenue, of customers or of reputation are excluded.
9. Intellectual property
The service, its name, its design and its software remain the property of the Publisher. You receive a personal, non-exclusive, non-transferable licence to use it for the duration of your account. You own the replies you publish. You grant the Publisher the right to process the reviews you paste and the profile you enter for the sole purpose of providing the service.
10. Changes to the service and prices
We may improve or modify the service at any time. Any change to prices or to these Terms that is unfavourable to you will be announced by email at least 30 days before it applies. If you disagree, you can cancel before that date; continuing to use the service afterwards means you accept the change.
11. Duration, suspension, termination
The contract runs for as long as your account exists. You may delete your account at any time from the Account screen, which erases your data immediately. We may suspend or close an account, after notice unless the situation requires immediate action, in case of breach of these Terms, non-payment or unlawful use.
12. Governing law and disputes
These Terms are governed by French law. In case of a dispute, we invite you to contact us first at hello@kindfollow.com. Consumers may also use the European online dispute resolution platform (ec.europa.eu/consumers/odr) or the consumer mediator of which the Publisher is a member; the mediator's details are available on request and will be added to this page once the membership is finalised. Failing an amicable solution, the competent courts are those provided by French law; for consumers, the court of their place of residence remains competent.
